1. Acceptance of Terms
BostonSpeaks, LLC (“BostonSpeaks,” “Company,” “we,” “us,” or “our”) provides public speaking coaching, training services, programs, workshops, and related content (collectively, the “Services”) through this website (the “Website”).
By accessing this Website or purchasing any Services, you agree to be bound by these Terms of Use & Service Policies (“Terms”) and our Privacy Policy.
You agree that you are accessing the Services on Our Website for business purposes. If you are using the Service on behalf of an organization, You are agreeing to these Terms for that organization and confirming now to BostonSpeaks that you have the authority to bind said organization to Our Terms of Service (in which event, “You” and “Your” will refer to that organization).
If you do not agree with these Terms, or are under 18 years old, please do not use the Services or Our Website. If at any time you are not willing to be bound by these Terms, You should:
- Click the “I do not accept” or similar button,
- Terminate any download and/or installation process,
- Immediately cease and refrain from accessing or using the program, and
- Delete any copies you may have.

2. Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and BostonSpeaks. You are purchasing coaching and training services as an independent client.
BostonSpeaks provides educational and coaching services only. We do not provide medical, psychological, legal, or financial advice.

3. Intellectual Property
All materials provided through the Website or Services — including but not limited to videos, workbooks, presentations, frameworks, methodologies, trademarks, branding, written materials, and proprietary processes — are the exclusive property of BostonSpeaks, LLC and are protected by copyright and intellectual property laws.
Purchase of any Service grants you a limited, non-transferable, non-exclusive license for your personal use only.
You may not:
- Copy, reproduce, republish, distribute, or publicly display materials
- Create derivative works
- Share login credentials
- Teach or replicate our methodology
- Use materials for commercial resale
Unauthorized use constitutes a material breach of these Terms.

4. Accounts & Access
If you create an account, you agree to provide accurate and current information.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
BostonSpeaks reserves the right to suspend or terminate accounts for:
- Credential sharing
- Misuse of content
- Violation of these Terms

5. Coaching Services & Separate Agreement
Certain Services require execution of a separate Coaching Agreement.
In the event of any conflict between these Website Terms and a signed Coaching Agreement, the Coaching Agreement shall control.

6. The Confident Guarantee
BostonSpeaks stands behind the effectiveness of The Confident Speaker Method.
If you fully participate in the program and complete all required components, and you do not experience measurable reduction in public speaking anxiety by the completion of the program, you may request a refund in accordance with the terms outlined below and in your signed Coaching Agreement.
To qualify for a refund under the Confident Guarantee, you must complete the following requirements within the ninety (90) day program period beginning on the date of purchase:
- Attend all scheduled coaching sessions
- Submit all required assignments
- Complete all videos in the Speaking Anxiety Presentation (Minus the Speaker Success Panel Section)
- Complete all videos and exercises in the The Confident Speaker Method (Phase One, Two, and Three)
Submission for this refund must happen within 14 days of completing the 90 Day Program.Â
Eligibility determination is at the sole discretion of BostonSpeaks and must align with documented program participation.
Full details of the Guarantee are outlined in the signed Coaching Agreement.

7. Refund Policies (Non-Guarantee Programs)
Unless otherwise stated in writing:
1-on-1 Coaching ProgramsÂ
[Including “The Confident Speaker Method” and “The Influential Speaker Method”]
Refund requests must be submitted within 24 hours of purchase.
Unused sessions after early program success
We don’t offer refunds for unused sessions if your goals are reached ahead of schedule, then you’ve accomplished the intention of the program. You are welcome to end the program early or use any sessions for further mindset around your public speaking.Â
Workshops
See workshop contract for policy.
In Person or Virtual Speaking Classes
If you need to cancel, no refunds will be offered but we will credit you for an upcoming class.
No refunds or credits after the class has been attended.Â
The Speaker Pass
Refund requests must be submitted within 7 days of purchase.
Delivered Coaching Sessions
No refunds.
Online Courses
No refunds.
Upgrades (including TEDx Speaker Course, Influential Speaker Program)
No refunds.
Corporate training refunds are governed exclusively within the written agreement.

8. Payment Plans & Third-Party Financing
Third-Party Payment Providers
BostonSpeaks may offer payment plan options through third-party providers, including but not limited to Klarna.
If you elect to use a third-party financing option:
- You are entering into a separate agreement directly with the financing provider.
- You agree to be bound by that provider’s terms and conditions.
- BostonSpeaks is not responsible for financing decisions, payment schedules, interest charges, fees, account actions, or collection activity initiated by the third-party provider.
BostonSpeaks is not a lender and does not control or influence the terms, underwriting decisions, or collection policies of third-party financing providers.
All disputes regarding payment terms, billing, interest, or repayment obligations must be directed to the financing provider.
Payment Plans Policy
Your obligation to complete payment under any financing arrangement remains independent of your participation in or satisfaction with the Services, subject only to any applicable refund provisions explicitly stated in these Terms or your signed Coaching Agreement.
If financing approval is revoked, declined, or reversed, BostonSpeaks reserves the right to suspend access to Services until payment is resolved.
If you enroll in a payment plan, you agree to complete all scheduled payments regardless of early completion of goals, usage of sessions, or desire to finish the program.
Payment obligations reflect the full value of the program and are not tied to session or program utilization.Â
Failure to complete scheduled payments may result in suspension of access to Services and may be referred to collections where permitted by law.
9. Scheduling, Cancellation & Expiration
Clients are responsible for scheduling sessions in a timely manner.
Sessions must be rescheduled with at least 24 hours’ notice. Sessions cancelled with less than 24 hours’ notice may incur a $50 late cancellation fee at BostonSpeaks’ discretion.
Failure to attend a scheduled session without notice may result in forfeiture.
It is the speaker’s responsibility to maintain up-to-date contact information and to check their email and phone regularly to ensure they do not miss important scheduling messages from BostonSpeaks or their coach.Â
If a client fails to respond to scheduling outreach to begin their program, BostonSpeaks will provide notice. If no session is scheduled within 28 days of initial outreach, remaining sessions may be forfeited.
The ninety (90) day program period begins on the date of purchase unless otherwise stated in writing. Coaching sessions must be fully used within the 90 day program container. Failure to complete all coaching sessions within that timeframe may result in forfeiture.
Any extensions are at BostonSpeaks discretion and must be received in writing.Â
Expired packages are not eligible for refund, extension, or reactivation.
10. Confidentiality
BostonSpeaks agrees to maintain confidentiality of information shared during coaching sessions, except as required by law.
If a Client voluntarily leaves a review or testimonial in a public forum, the Client grants BostonSpeaks permission to repost or reference that review for marketing purposes unless the Client provides written notice requesting removal.
Speaker Success Panels will be open to the public but only reposted within the Speaker Anxiety Presentation unless BostonSpeaks requests permission to use in a different context.Â
If a review is left in a public setting, the Client agrees by action of leaving the review.Â
Clients agree not to disclose proprietary methodologies, frameworks, or confidential business information of BostonSpeaks.

11. No Warranties
By accepting these Terms, You agree and understand that We provide training and public speaking coaching services only and guarantee no specific results.Â
Any public speaking results viewable on this Website or our related Social Media are based on actual individual results of our clients and/or estimates as may be stated.Â
There is no guarantee that you will have these same results. Your results will vary and will be based on your personal abilities, experience, knowledge, capabilities, level of desire, and an infinite number of variables beyond Our control, including some variables that neither We nor You may have anticipated.Â
There are no guarantees concerning the level of success You may experience. Each person’s results will vary.
There are unknown risks in any training and coaching services. The use of our information, products, and services should be based on your own due diligence and YOU ACKNOWLEDGE THAT BOSTONSPEAKS IS NOT LIABLE FOR YOUR BUSINESS, CAREER, OR PERSONAL OUTCOMES.
In accepting these Terms, You acknowledge that You take full responsibility for your own success.

12. Limitation of Liability
To the fullest extent permitted by law:
BostonSpeaks shall not be liable for indirect, incidental, special, or consequential damages.
Total liability for any claim arising out of Services shall not exceed the amount paid by you for the specific Service giving rise to the claim.
Client agrees to indemnify and hold harmless BostonSpeaks from any claims, damages, liabilities, or expenses arising from Client’s misuse of the Services or violation of these Terms.
13. Force Majeure
BostonSpeaks shall not be liable for delay or failure in performance due to events beyond reasonable control, including but not limited to illness, internet outages, governmental actions, or acts of God.
BostonSpeaks reserves the right to assign or reassign coaches at its discretion.

14. Termination
We reserve the right to terminate Website access or Services if you violate these Terms.
You may terminate your account at any time by written notice.

15. Modifications & Waiver
Modification of Services
BostonSpeaks reserves the right to modify, suspend, or discontinue any Services, features, or content offered through the Website or related platforms at any time without prior notice. We may introduce new services or features in the future, and such additions shall be subject to these Terms.
No Waiver
Failure by BostonSpeaks to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of BostonSpeaks.

16. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts.
You agree to exclusive jurisdiction and venue in Massachusetts courts for any disputes arising under these Terms.

17. Severability
If any provision is found unenforceable, the remainder of these Terms shall remain in full force and effect.
